Short-term disability and FMLA?
I was in a car accident at 17 weeks into my pregnancy. I am a high risk pregnancy to begin with, because miscarriages before and only 3 live births 1. During the accident, which did something to my back — tests positive for nerve damage and irritation of the L5-S1 nerve root. Also I have all the symptoms of a herniated disc, but the MRI was negative. The pain is excrutiating. I was put on bedrest by my neurologist and OB / GYN agree that bed rest was the only way to relieve pain and prevent possible further damage since the tests during pregnancy is limited. Now that you have the background — I was given for 12 weeks FMLA only? I never received my inability to pay and now I'm being told that my FMLA is not extended. Any suggestions? I've been with this company for more than five years and the director says I'll have my work on their return, but the company's corporate offices and Insurance seems to have different ideas? Constructive comments only please!
Standard law gives you 12 weeks of FMLA. Possibly at that time you may return to work. If you are not ready to return to work soon and that the company does not want to grant him an extended leave then you will be fired from his job. You may continue to receive disability until you are ready to return to work.
